The terms and conditions outlined below apply to sales of software and products and to non-exclusive licenses for image use. Please take time to carefully read through the terms and conditions. If you do not agree with the terms and conditions, do not place orders for any of our products or images. If you do access the website and/or place an order, you thereby agree to be bound by the terms and conditions set forth in this section.

How to Order - All orders can be placed online through the website or through direct email. Please do not email credit card details without first contacting us. Neither Molecular Expressions nor the Florida State University Research Foundation can accept responsibility for the security of credit card or personal information sent through email. All orders are subject to availability and will be processed and completed upon receipt of full payment, or approval of the credit transaction. Orders will be processed in the order in which they are received. Completion of orders and shipment of products and images are subject to availability.

Method of Payment - Payment for licenses or products can be made by credit card (Visa and MasterCard), electronic wire transfers, and personal or corporate checks made payable to the Florida State University Research Foundation. If a credit card is utilized to make a purchase, the cardholder's name, as it appears on the card, must be provided along with the expiration date. Credit card fraud is illegal and violations are subject to prosecution in accordance with statutes issued by the State of Florida.

Pricing Policy - All products, software, and images on the Molecular Expressions website are priced in United States dollars, with an additional sales tax included only for Florida residents. For all international orders, any duties or local taxes are payable by the customer or licensee at the appropriate local rate.

Delivery - Delivery of images and software generally is conducted via the Internet and products are shipped through Federal Express or United Parcel Service. We can also ship electronic products on CD (Compact Disk) or DVD (Digital Versatile Disk) using Federal Express, United Parcel Service, or the United States Mail system at additional shipping and handling costs. Any other shipping requests such as, but not limited to, United States Postal Service Priority Mail, Express Mail, or international shipping (outside the United States of America), will be at the expense of the customer or licensee and shall be assessed at the time of shipping. The maximum period of delivery should not exceed 14 days, unless specifically agreed to with the customer or licensee. We will immediately inform customers and licensees of expected delays in shipment.

Return Policy - All sales of software and image licenses are final. Other products, such as neckties, mouse pads, posters, etc., can be returned for a full refund (including delivery charge and sales tax, if applicable) if they are faulty or if the wrong item(s) has been dispatched, within 14 days of delivery. If the correct products are ordered and received, they may also be returned for a full refund within 14 days if they are shipped back to us at the customer's expense. All returns must be pre-approved by Molecular Expressions via email. Returned products must be unused, still have their original packaging and labeling, and be accompanied by the original delivery invoice. Exchanges for products of equal or lesser value will be made if the customer or licensee assumes shipping costs. Nothing in these conditions affects the statutory rights of our customers or licensees. Credit cards utilized by the customer or licensee for purchases will be credited with the original purchase amount after returned goods have been received and inspected. All sales are considered final 30 days from the postmarked date on the original shipping package (the postmarked date on which the item shipped from Molecular Expressions to the customer or licensee) or upon return (in original condition) for refund or exchange.

Out-of-Stock - If an item is ordered that becomes out of stock prior to receipt of the order, the customer or licensee will be contacted via email and offered currently stocked items as a substitute. In the event a substitution is not satisfactory, the credit card information will not be processed and instead deleted from the server database.

Privacy - Our product and image order forms request information from the customer or licensee as required to conduct transactions. The customer or licensee must provide contact information, such as contact name, shipping address, email address, telephone number, and financial information (credit card number and expiration date) necessary for the sale or license. This information is used for billing purposes and to fill the customer or licensee order. In the event a problem arises in processing an order, this information will be utilized to contact the customer or licensee. Neither the Molecular Expressions website nor the Florida State University Research Foundation will divulge this information to any other parties under any circumstances.

Security - The Molecular Expressions website and the Florida State University Research Foundation take all necessary precautions to protect customer or licensees' credit card and personal information. This information is not made available to any outside agency. When sensitive information is submitted via the website, that information is encrypted and is protected during transfer with a Secure Sockets Layer (SSL; a protocol for transmitting private documents via the Internet) authenticated by VeriSign. The computer servers on which personal and credit card information is collected and stored are maintained in a totally secure environment.

Limitation of Liability - All products, software, and images displayed, discussed, exhibited, sold, and/or licensed through the Molecular Expressions website are exhibited, sold, and licensed as is. The mission of the Molecular Expressions website and the Florida State University Research Foundation is to foster an educational atmosphere through the exhibit and sale of Molecular Expressions products, software, and the licensing of images. The Molecular Expressions website and the Florida State University Research Foundation therefore provide no warranties on the products, software, and images gathered and exhibited on the website, and we do not guarantee that information, text, images, and links will be transmitted or reproduced with perfect accuracy to/on customer's or licensees' personal computers/monitors or other viewing/electronic media.

Complaints - The primary goal of the Molecular Expressions website and the Florida State University Research Foundation is to educate and please our customers and licensees. Complaints about service, products, shipping delays, and other unforeseen circumstances will be handled as effectively as possible. In the first instance, email complaints to the Molecular Expressions Sales Staff for the most rapid response. Alternatively, complaints can be mailed through the postal service directly to Molecular Expressions, 1800 E. Paul Dirac Drive, Tallahassee, Florida, 32310. If you choose to send a complaint via the postal service, be sure to include your telephone number, email address, and return postal address. Complaints will be answered within seven (7) working days.
